Please read these terms and conditions carefully before using our website, products or services. By accessing or using our trade services, you agree to comply with and be bound by the following terms and conditions.
General Information
Pricing & VAT
All prices shown exclude VAT, which will be charged at the prevailing rate at the time of invoicing.
Prices may change without notice, however we will confirm pricing on your order confirmation/pro-forma/invoice.
Delivery, Carriage & Collection
Delivery is by arrangement only. Carriage will be charged at cost. Please contact us to discuss delivery options and availability.
Orders with a value below £1,500 may incur a delivery charge starting from £75, added at the invoicing stage where delivery has been arranged.
Collection from Rochester, Kent is by appointment only. Our magazines are some distance from the office and stock may need to be transferred prior to collection.
Any delivery/collection dates or timings provided are estimates and may vary due to transport arrangements, regulatory requirements, operational constraints, or events outside our control.
Payments & Credit Accounts
Payment by BACS, PayPal, cheque, or cash must be received with the order or on collection, unless an approved credit account is held.
Where a credit account is approved, payments must be made strictly in accordance with the agreed credit terms.
We reserve the right to request payment on a pro-forma basis at any time (for example where a customer is new, where order values change, or where payment history requires it).
Orders & Acceptance
All orders are subject to acceptance by Phoenix Fireworks.
We reserve the right to refuse, cancel, or amend an order (including quantities) where stock availability, compliance, payment, or operational factors require it.
Order amendments requested by the customer after acceptance may not be possible and may affect pricing, availability, and delivery arrangements.
Deposits
For requested imports, special orders, or products sourced specifically at a customer’s request, we may require a deposit to confirm the order.
Deposits secure supplier allocation and may cover supplier commitments, shipping, and administrative costs.
Deposits are non-refundable once we have committed the order with our supplier, unless we are unable to supply the goods.
The remaining balance must be paid by the agreed date prior to dispatch/collection unless an approved credit account is held.
Import lead times are estimates only and may be affected by supplier schedules, customs, transport, regulatory checks, and factors beyond our control.
Product Information, Classification & Compliance
All products supplied are sold with the appropriate classification and compliance information as required for professional handling and storage.
Where applicable, CAD documents (and/or supporting classification documentation) used for licensing and storage purposes can be provided on request.
Product images, descriptions, and performance details are provided for guidance. Manufacturers may update packaging, artwork, labelling, or specifications from time to time.
All timings are approximate and may vary from those stated on the website.
Age Restrictions
Phoenix Fireworks will not sell or supply fireworks or pyrotechnic articles to any person under 18 years of age.
By placing an order, the customer confirms that the person placing the order is 18+ and has authority to purchase on behalf of the business.
For collection or delivery, the customer confirms that the person receiving/collecting the goods is 18+ and authorised.
We reserve the right to request proof of age and/or authority at any stage and to refuse, cancel, or withhold supply where this cannot be verified.
The customer must not resell or supply any fireworks or pyrotechnic articles to persons under 18 and must comply with all applicable age-restriction laws and regulations.
Stock Reservations
We may offer stock reservation for popular or limited items, subject to availability.
A reservation deposit may be required to hold stock for an agreed period.
Reserved stock is held for the agreed reservation window only. If the balance is not paid by the deadline, we may release the stock back to sale and the reservation deposit may be retained to cover administration/holding costs (unless otherwise agreed in writing).
Reservation deposits and timeframes will be confirmed in writing (email is acceptable).
Stock Levels, Availability & Substitutions
- Stock levels displayed on the website are intended to be accurate but may change due to sales activity, transfers, and operational updates. Availability is subject to prior sale.
If an ordered item is out of stock, or if there is an error with displayed stock numbers, we will contact you to agree one of the following options:
Substitute with the closest suitable product available; or
Remove the affected item(s) from the order.
Substitutions will only be made following communication and agreement (email or phone).
Where a substitute is agreed, we will confirm the replacement product and any price difference prior to invoicing/dispatch.
Risk, Responsibility & Title of Goods
Risk and responsibility for goods transfers to the buyer upon collection, or upon delivery where delivery has been arranged.
Title to goods remains with Phoenix Fireworks until payment has been received in full and cleared.
Returns
Due to the nature of fireworks/pyrotechnic goods and compliance requirements, returns may be restricted and are subject to approval.
No returns will be accepted without prior written agreement from Phoenix Fireworks.
Where a return is approved, goods must be returned in accordance with instructions provided, and may be subject to inspection and compliance checks before any credit/refund is issued.
Any approved returns may be subject to restocking/handling charges where appropriate (to be confirmed in writing).
Issues & Reporting Window
Customers should inspect goods on receipt/collection where reasonably possible.
Any issues (including shortages, incorrect items, or damage concerns) must be reported within 14 days of delivery or collection.
Please provide clear details and, where possible, photos of packaging and product labels/batch information to assist investigation.
Do not dispose of packaging or labels until the issue is resolved, as these may be required for investigation.

A downloadable list of products is available on request.
This document is typically updated monthly, therefore we recommend using the website for the most up-to-date stock levels and product information.
Limitation of Liability
Nothing in these terms limits liability where it is unlawful to do so (including for death or personal injury caused by negligence).
Subject to the above, Phoenix Fireworks shall not be liable for indirect or consequential losses, including loss of profit, business, or opportunity.
Our total liability in connection with any order shall not exceed the value of the goods supplied under that order.
Website Use & Intellectual Property
Unauthorised copying, scraping, redistribution, or commercial reuse of website content (including pricing, product data, and downloads) is not permitted without written permission.
We reserve the right to correct errors on the website (including pricing, descriptions, and stock levels).
Governing Law
- These terms and conditions are governed by the laws of England and Wales, and any disputes will be subject to the jurisdiction of the courts of England and Wales.

Terms of Trade (Category 4 Fireworks)
Supply Eligibility
We will only supply Category 4 fireworks to bonfire display companies and recognised professional fireworks bodies.
Under no circumstances shall Category 4 material be supplied or sold to the general public.
Mandatory Requirements
To purchase Category 4 goods, you must be able to demonstrate the following:
Appropriate licensed storage for the category and quantity being purchased.
Valid Public Liability and Products Liability insurance appropriate for your activities.
Any other documentation reasonably required to verify bona-fide professional status and lawful purchase/possession.
We require copies of relevant documentation before we can approve Category 4 supply.
Ongoing Compliance & Renewals
Documentation must be current and in date.
You agree to provide updated documentation upon renewal or on request.
Where documentation expires, becomes invalid, or is not provided on request, we may suspend Category 4 supply until compliance is confirmed.
Right to Refuse, Suspend or Cancel Supply
We reserve the right to refuse, suspend, or cancel Category 4 supply at any time if we are not satisfied that legal and safety requirements are met.
Any breach of these terms (including resale/supply to the public) may result in immediate refusal of supply and/or account suspension.
Customer Responsibilities
The customer is responsible for ensuring transport, handling, and storage arrangements are lawful, safe, and suitable for the classification of Category 4 goods purchased.
Where delivery is arranged, the customer must ensure suitable access, lawful receiving arrangements, and an authorised person available to receive the goods at the agreed time.
Professional Use & Restrictions
Category 4 goods are supplied for professional use only.
The customer agrees to use and handle Category 4 goods in accordance with manufacturer instructions, relevant legislation, and best practice.
The customer must not repackage, relabel, or otherwise alter Category 4 products in any way that could affect compliance or safety.
Trade Account Conduct
Category 4 access is approval-only and may be withdrawn where there are compliance, safety, or payment concerns.
Misuse, non-compliance, attempted public resale, or failure to maintain required documentation may result in suspension of Category 4 access.
Limitation of Liability
Nothing in these terms limits liability where it is unlawful to do so.
Subject to that, Phoenix Fireworks shall not be liable for indirect or consequential losses arising from the purchase, transport, storage, or use of Category 4 goods.
Liability shall not exceed the value of the Category 4 goods supplied under the relevant order.
